Introduction

Fingerprint match evidence is recognized by the legal system as one of the strongest elements in establishing the guilt or innocence of a person charged with a crime. If a person's print is on a piece of real evidence such as a gun, knife, or the steering wheel of a getaway car, it is generally accepted that the person was involved in the crime. The foundation for the forensic science of fingerprint analysis comes from its longevity of use without oppositional findings questioning its reliability. One hundred years without being proven false is accepted by the court system as the smoking gun in proving guilt or innocence. It is further bolstered by the belief that no two fingerprints are alike, and if a match is found, logic propels the conclusion that it could not be the case that someone else has a similar print and could be the guilty party. It has been noted that even identical twins do not have matching prints.

THE LATEST

"Park West has ordered ALL OLD MASTER works of art OFF of ALL ships worldwide immediately. Specifically, any works with signatures by ANY Master (Picasso, Chagall, Miro, Rembrandt, etc.) These are to include works such as Zami Steynovitz as well. Anything with a signature is being removed! Some ships have returned over 100+ works of art to the Park west Gallery Miami Lakes warehouse. They are leaving the animation signatures and sports signatures (Muhammed Ali) on board.

I am sure you can see right thru this move. They [Park West Gallery] are paranoid about signature works being on ships right now...interesting!"

Curiosity Cuts Man's Family Cruise Short

New York resident removed from Royal Caribbean cruise ship in Norway over Park West Gallery art auction critisim. Robert Marchant reports on the man, Mark Jacobs, who was escorted by Oslo Police off the cruise ship, seperated from his family who stayed aboard, and left in foreign country.

Strategic Litigation Against Public Participation (SLAPP): First Amendment Free Speech and Expression under Attack

Introduction

Over the last 30 years, there has been a steady and progressively increasing movement by some individuals, corporations and members of government to unravel, compress, and lessen First Amendment rights of speech, expression, and petition by a mechanism called a Strategic Litigation Against Public Participation lawsuit, otherwise known as a SLAPP.

George Pring and Penelope Canan, the University of Colorado professors who defined the concept of the SLAPP suit and coined the term, note that in such suits the goal is not to win but rather to silence, intimidate, and crush critics into submission via the legal system. New York Supreme Court Judge J. Nicholas Colabela has stated, "...short to a gun to the head, a greater threat to First Amendment expression [than SLAPP] can scarcely be imagined." Pring and Canan argue that such suits for the defendant are costly, time consuming, (at least 40 months), ultimately chill free speech in the future and almost always result in a loss for the plaintiff or originator of the suit. The loss of victory in the suit for the plaintiff is actually a success in that it takes time away from the defendant in being able to promote the criticism challenging the plaintiff.
